These Terms and Conditions set out the basis on which Rubbish Removal Finsbury Park provides waste collection and rubbish clearance services to domestic and commercial customers. 1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Customer means any individual, business, company, organisation or other entity that requests or uses our rubbish removal, waste collection or related services.
1.2 Services means any rubbish removal, junk clearance, bulky waste collection, garden waste removal, office clearance, house clearance or related services provided by us.
1.3 Waste means any materials, goods, items, refuse or rubbish that the Customer requests us to remove, excluding any items which we are not legally permitted to handle.
1.4 Booking means a confirmed appointment for the provision of Services, whether made by telephone, email, online form or in writing.
1.5 We, us and our refer to the rubbish removal service trading as Rubbish Removal Finsbury Park.
2. Scope of Services
2.1 We provide rubbish removal and waste collection services primarily within Finsbury Park and surrounding areas. Availability in specific locations and at particular times is subject to operational capacity and scheduling.
2.2 Our Services may include loading Waste onto our vehicles, transporting it to a licensed waste transfer facility or recycling centre, and disposing of it in compliance with applicable waste regulations.
2.3 We reserve the right to refuse to remove any items that we reasonably believe are hazardous, illegal, excessively heavy, unsafe to handle, or otherwise unsuitable for collection.
2.4 The Customer is responsible for describing the Waste accurately at the time of Booking, including type, approximate volume, and any special handling requirements.
3. Booking Process
3.1 Bookings may be made by telephone, email or through our online enquiry channels. A Booking is only confirmed when we have accepted it and provided a scheduled date or time window for the Service.
3.2 When making a Booking, the Customer must provide accurate contact details, the collection address, access information, and a clear description of the Waste. We may request photographs to help assess the volume or type of Waste in advance.
3.3 Any quotation provided before attendance is based on the information supplied by the Customer and is therefore an estimate only. If, upon arrival, the actual volume, weight or nature of the Waste differs from the description given, we may revise the price or refuse to carry out part or all of the Service.
3.4 The Customer must ensure that an authorised person is present at the agreed time to provide access, confirm the items to be taken, and approve any amended charges before work begins.
3.5 Time windows for collection are estimates and not guaranteed. We will make reasonable efforts to attend within the agreed period but shall not be liable for minor delays caused by traffic, weather, operational issues or events beyond our reasonable control.
4. Access and Parking
4.1 The Customer is responsible for ensuring safe, reasonable and lawful access to the premises for our staff and vehicles. This includes ensuring that driveways, hallways, staircases and access points are clear and suitable for moving the Waste.
4.2 Where parking restrictions apply, the Customer must inform us in advance and, where possible, arrange suitable parking or provide necessary permits. If we incur parking charges, these may be added to the final invoice.
4.3 If we are unable to access the premises or the Waste due to circumstances within the Customer's control, we may charge a call-out or cancellation fee to cover our reasonable costs.
5. Pricing and Quotations
5.1 Our prices are generally based on volume, weight, labour time, type of Waste and any special handling requirements. We may also consider factors such as access difficulties, distance from vehicle to Waste, and the need for additional staff.
5.2 Any quotation given before we have inspected the Waste is an estimate only. The final price will be confirmed on site once our staff have assessed the actual Waste to be removed.
5.3 Where the Customer has significantly under-described the Waste, we may offer to remove only some of the items within the original estimate or provide a revised quotation for the entire load. The Customer may choose whether to proceed on this basis.
5.4 All prices quoted are inclusive or exclusive of any applicable taxes as explicitly stated at the time the quotation is provided.
6. Payments
6.1 Payment is due in full upon completion of the Service unless otherwise agreed in writing prior to the Booking. We may require a deposit or pre-payment for larger or commercial jobs.
6.2 We accept payment by cash, debit card, credit card or other methods that we specify from time to time. For business customers, we may, at our discretion, offer invoicing terms subject to credit checks.
6.3 Where invoices are issued, payment must be made within the period stated on the invoice. If no period is stated, payment shall be due within 14 days from the date of the invoice.
6.4 If the Customer fails to make payment when due, we reserve the right to charge interest on the overdue amount at the statutory rate and to recover any reasonable costs incurred in pursuing the debt.
7. Cancellations and Amendments
7.1 The Customer may cancel or amend a Booking without charge by giving us at least 24 hours notice before the scheduled collection time.
7.2 If the Customer cancels or significantly amends a Booking with less than 24 hours notice, we may charge a reasonable cancellation fee to cover our administrative and travel costs.
7.3 If, upon arrival, we are unable to perform the Service due to the Customer's failure to provide access, or if the Waste is materially different from that described and the Customer declines revised charges, we may treat this as a late cancellation and charge a call-out fee.
7.4 We reserve the right to cancel or reschedule a Booking at any time in the event of circumstances beyond our reasonable control, including but not limited to severe weather, vehicle breakdown, staff illness, or safety concerns. In such cases, we will notify the Customer as soon as reasonably practicable and offer a new appointment time.
8. Customer Obligations
8.1 The Customer warrants that they are either the owner of the Waste or are authorised by the owner to arrange its removal.
8.2 The Customer must clearly identify the items to be removed and ensure that no items of value or items intended to be kept are mixed with the Waste. Our staff will not be responsible for the accidental removal of items that were not clearly separated or identified.
8.3 The Customer must inform us of any items that may present a health and safety risk, such as sharp objects, contaminated materials, or heavy items requiring special handling.
8.4 The Customer shall not request us to remove any items that we are not legally permitted to carry, including but not limited to asbestos, medical waste, certain chemicals, pressurised containers or other hazardous materials, unless previously agreed in writing and subject to appropriate licences and procedures.
9. Waste Regulations and Disposal
9.1 We operate in accordance with applicable UK waste management legislation and regulations. All collected Waste is transported to licensed facilities for disposal, recycling or recovery.
9.2 We will provide waste transfer documentation where required by law or where reasonably requested by commercial customers. The Customer agrees to retain such documentation in line with regulatory requirements.
9.3 We will use reasonable efforts to recycle or recover Waste where possible, subject to the nature of the materials and the facilities available. However, no guarantee is given that any particular item will be recycled.
9.4 Once the Waste has been loaded onto our vehicle and we have left the site, title and responsibility for that Waste transfers to us, and the Customer has no further rights in relation to it.
10. Liability and Limitations
10.1 We will exercise reasonable care and skill in providing the Services. However, we shall not be liable for any loss or damage that was not reasonably foreseeable at the time of entering into the contract, or for any loss of profit, loss of business, or indirect or consequential loss.
10.2 The Customer is responsible for protecting floors, walls, driveways and other surfaces where necessary. While our staff will take reasonable care, we shall not be liable for minor scuffs, marks or damage that occurs as a result of moving heavy or bulky items in confined spaces, provided we have acted with reasonable care.
10.3 If we are found liable for any damage to property caused by our negligence, our liability shall be limited to the reasonable cost of repair or replacement, subject to a fair wear and tear deduction.
10.4 Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other matter for which it would be unlawful to exclude or limit liability.
10.5 The Customer shall be liable for any loss or damage suffered by us as a result of their breach of these Terms and Conditions, including any costs incurred due to failure to disclose hazardous materials or misrepresentation of the Waste.
11. Complaints
11.1 If the Customer is unhappy with any aspect of the Service, they should notify us as soon as possible, and in any event within 48 hours of completion of the work, giving full details of the concern.
11.2 We will investigate all complaints in good faith and aim to respond within a reasonable time, seeking to resolve the issue fairly, which may include, where appropriate, a partial refund, re-attendance, or another remedial action.
12. Insurance
12.1 We maintain public liability insurance and other relevant insurances appropriate to our business. Details of cover can be provided on request.
12.2 The existence of insurance does not extend or increase our liability beyond that which is set out in these Terms and Conditions.
13. Data Protection and Privacy
13.1 We collect and process personal data such as names, contact details and addresses for the purpose of providing our rubbish removal and waste collection services, managing bookings, and handling payments.
13.2 We will handle personal data in accordance with applicable data protection laws and use it only for legitimate business purposes connected with the provision of our Services or as required by law.
13.3 The Customer is responsible for ensuring that any personal data contained within items or documents placed in the Waste is removed or destroyed before collection, as we do not examine the contents of bags, boxes or containers before disposal.
14. Force Majeure
14.1 We shall not be liable for any delay in performing or failure to perform our obligations under these Terms and Conditions if such delay or failure results from events, circumstances or causes beyond our reasonable control, including but not limited to extreme weather, strikes, accidents, emergencies, or acts of government.
14.2 In such circumstances, we shall be entitled to a reasonable extension of time to perform our obligations or, where performance is impossible, to cancel the affected Booking without liability, other than to refund any advance payment for Services not provided.
15. Changes to Terms and Conditions
15.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, or our business practices.
15.2 The version of the Terms and Conditions that applies to a Booking is the version in force at the time the Booking is confirmed. Customers are advised to review the current Terms and Conditions before placing a new Booking.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.
17. General Provisions
17.1 If any provision of these Terms and Conditions is found to be invalid, illegal or unenforceable, such provision shall be deemed deleted, but this shall not affect the validity and enforceability of the remaining provisions.
17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy, nor shall any single or partial exercise of any right or remedy prevent any further exercise of that or any other right or remedy.
17.3 These Terms and Conditions constitute the entire agreement between the Customer and us in relation to the provision of Services and supersede any prior understandings, agreements or representations, whether oral or written, regarding such subject matter.
By making a Booking with Rubbish Removal Finsbury Park or by allowing our staff to commence work, the Customer acknowledges that they have read, understood and agreed to be bound by these Terms and Conditions.
